1. Introduction

Welcome to FANSCORT. These Terms of Use, hereafter the “Terms”, define the rules for accessing and using the FANSCORT website, its services, features, profiles, listings, messaging system, paid options and verification tools.

By accessing the website or using its services, the user acknowledges having read, understood and accepted these Terms without reservation.

FANSCORT is a platform for publishing listings, connecting users and enabling communication between adult users. The platform acts as a hosting service, profile presentation service and provider of technical tools. FANSCORT is not a party to any exchanges, discussions, agreements, meetings or relationships between users and does not provide any sexual service, escorting service, companionship service or prostitution service.

2. Access to the website and age requirement

• 2.1 Access to the website is strictly reserved for adults, meaning persons aged at least 18 years old or who have reached the legal age of majority in their country of residence when that age is higher.
• 2.2 Any minor, or any person lacking the legal capacity to use the service, must leave the website immediately.
• 2.3 The user declares and warrants that they are of legal age, have the necessary legal capacity and use the website in compliance with the laws applicable in their country.
• 2.4 FANSCORT may restrict, suspend or refuse access to the website or to certain features depending on the country, legal obligations, security, fraud risks, compliance risks or internal moderation policies.

3. Account creation and security

• 3.1 When creating an account, the user agrees to provide accurate, complete, fair and up-to-date information.
• 3.2 The user is responsible for maintaining the confidentiality of their login credentials and for all activity carried out through their account.
• 3.3 It is prohibited to create an account in the name of a third party, impersonate another person, use photos, videos or data belonging to another person without authorization, or create a misleading profile.
• 3.4 Any account that is suspicious, fraudulent, impersonated, automated, used to bypass a sanction or created in breach of these Terms may be suspended or deleted without compensation.
• 3.5 The user must inform FANSCORT without delay in the event of unauthorized use of their account or suspected compromise of their credentials.

4. Role of FANSCORT

• 4.1 FANSCORT acts as a technical platform allowing adult users to create a profile, publish content, view profiles, interact with other users and use certain free or paid features.
• 4.2 FANSCORT is not the employer, agent, representative, contractual intermediary or proxy of users.
• 4.3 FANSCORT does not guarantee the real identity, availability, honesty or future conduct of users, even when a verification badge is displayed.
• 4.4 Exchanges, meetings, communications outside the platform, private agreements and relationships between users are solely their responsibility.

5. Content published by users

• 5.1 The user is solely responsible for texts, photos, videos, information, listings, messages, comments and other content they publish, transmit or make accessible on FANSCORT.
• 5.2 The user warrants that they hold all rights, authorizations and consents required to publish the transmitted content, especially when such content represents another person.
• 5.3 It is prohibited to publish misleading, stolen, non-consensual, defamatory, insulting, hateful, discriminatory, violent, threatening, humiliating, harassing, fraudulent content, content contrary to human dignity or contrary to the law.
• 5.4 FANSCORT may moderate, hide, restrict, delete or refuse any content that violates these Terms, applicable laws, user safety or the platform's internal policies.
• 5.5 The user retains their rights over their content but grants FANSCORT a non-exclusive, worldwide, free license, limited to the duration necessary for the operation of the service, allowing FANSCORT to host, store, reproduce, display, technically adapt, resize, compress, translate, moderate and distribute such content within the platform.

5 bis. Voluntarily published sensitive data

• Certain content, preferences, descriptions, photos, videos, categories or information voluntarily published by the user on FANSCORT may reveal elements relating to their private life, intimate life, sexual orientation, personal preferences or other sensitive information under applicable regulations.
• When the user voluntarily chooses to publish such information on their profile, in their listing or through the platform’s features, they acknowledge that this information may be visible to other users or to the public depending on the available settings.
• The user expressly consents to the processing, hosting, display, moderation and technical distribution of this information as part of the operation of FANSCORT, within the limits of the visibility settings, the features used and the rules set out in these Terms of Use and the Privacy Policy.
• The user may modify, hide or delete certain published information according to the available features, subject to retention needs related to security, evidence, moderation, fraud prevention, reports, disputes or applicable legal obligations.

• 6.1 Content involving or appearing to involve minors is strictly prohibited, including content, descriptions, terms, scenarios, outfits, staging or references that may suggest minority, school context, incest, coercion, lack of consent or exploitation.
• 6.2 Child sexual abuse material, intimate content distributed without consent, revenge porn, non-consensual deepfakes, stolen content, content obtained through blackmail, pressure or manipulation, and any publication infringing a person's image rights or privacy are strictly prohibited.
• 6.3 It is prohibited to use FANSCORT to organize, offer, facilitate, promote or conceal pimping, human trafficking, sexual exploitation, forced prostitution, illegal recruitment, blackmail, extortion or any criminally punishable activity.
• 6.4 It is prohibited to harass, threaten, intimidate, manipulate, scam, fraudulently request money, distribute malicious links or use the platform for spam, phishing, abusive scraping, unauthorized automation or fraud.
• 6.5 FANSCORT applies a zero-tolerance policy regarding content involving minors, exploitation, coercion, identity theft, trafficking, blackmail, non-consensual distribution of intimate images and manifestly illegal content.
• 6.6 In the event of serious suspicion, FANSCORT may suspend the account, retain the elements necessary as evidence, restrict the relevant content and cooperate with competent authorities.

7. Profile verification

• 7.1 FANSCORT may offer several verification levels to strengthen trust between users and fight fake profiles, identity theft, fraud, repeat abuse and illegal content.
• 7.2 Level 1 is based on a verification selfie that may be analyzed automatically and/or manually. The user may choose whether or not to display this selfie on their profile. When the user chooses to publish it, it becomes publicly visible ; when they remove it, it is no longer publicly displayed.
• 7.3 Level 2 is based on a verification video. The user may choose whether or not to display this video on their profile. When the user chooses to publish it, it becomes publicly visible ; when they remove it, it is no longer publicly displayed. It is used to strengthen the reliability of the profile and the security of the platform.
• 7.4 Level 3 is based on prior validation of levels 1 and 2 and on the submission of private videos produced according to specific instructions. These private videos are never published on the profile and are never accessible to other users.
• 7.5 Obtaining a verification badge does not constitute an absolute guarantee of a user's real identity, honesty, exact age, availability or future behavior. It is only an additional reliability indicator.
• 7.6 In the event of serious doubt regarding age, identity, the authenticity of a profile, the origin of photos or videos published, or in the event of a report, suspicion of fraud, identity theft, illegal content or risk to user safety, FANSCORT may request additional proof of age or identity. Refusal to provide sufficient proof may lead to suspension, restriction or deletion of the account or relevant content.
• 7.7 The detailed terms for processing, accessing, retaining and deleting verification data are specified in the Privacy Policy.

8. Credits, paid options and digital services

• 8.1 Credits are an internal virtual unit usable only on FANSCORT to access certain features, options or digital services offered by the platform.
• 8.2 Credits are personal, non-transferable, non-refundable unless otherwise provided in these Terms, and may not be exchanged for money.
• 8.3 Paid features may include, among others, listing publication, visibility options, privileged contacts, certain verifications, boosts or premium features.
• 8.4 Prices, packs, features and terms of use are displayed on the website and may change at any time.
• 8.5 Credits, options, badges, boosts, privileged contacts and other paid features constitute digital services supplied upon validation of payment or activation.
• 8.6 When validating a purchase or activating a digital service, the user may be invited to request immediate performance of the service and acknowledge that they waive their right of withdrawal where applicable law allows it.
• 8.7 No refund is due in case of partial use, non-use, user error or account deletion/suspension for breach of these Terms, unless specifically provided by these Terms or applicable law.
• 8.8 Prices may or may not include applicable taxes depending on the country, currency, user status and local regulations. Where required, applicable taxes are displayed or included at the time of purchase.
• 8.9 Sapphire, Ruby and Diamond chests are digital gifts purchased directly, without Credits. They are delivered to the inventory after payment confirmation. Sending consumes the chest and may unlock a photo or video after moderation. The price is shown before purchase. The specific chest terms below govern these purchases in priority, without reducing statutory consumer rights.

9. Payments, security and fraud

• 9.1 Payments are made through secure payment providers. Full banking data is not stored by FANSCORT.
• 9.2 The user warrants that they have the necessary authorization to use the selected payment method.
• 9.3 Depending on the country, FANSCORT may offer manual payments such as bank transfer or other locally available payment methods. In such cases, credits or options are added only after actual receipt of funds and order validation.
• 9.4 FANSCORT may request proof, refuse an order, cancel credits or suspend an account in the event of anomaly, fraud, inconsistency, unpaid payment, disputed payment or suspicious activity.
• 9.5 Any abusive dispute, fraudulent chargeback, unauthorized use of a payment method or attempted fraud may result in account suspension, cancellation of obtained credits or benefits and, where applicable, legal action.
• 9.6 Fees charged directly to the user by their bank, crypto provider or network are payable under those third parties’ terms. Costs borne by FANSCORT are not automatically passed on to the user. The amount payable and any fees applied by FANSCORT are displayed before confirmation.

10. Privileged contacts and blocking

• 10.1 The “privileged contact” option allows enhanced interactions between two accounts, for example internal messaging, display of contact details or similar features, depending on the options available at the time of purchase.
• 10.2 Activating a privileged contact does not create any obligation to reply, be available, maintain a relationship, meet or continue interactions on the part of the other user.
• 10.3 Blocking prevails over any other feature. If either account blocks the other, interactions are immediately cut off, including those opened through the “privileged contact” option.
• 10.4 Blocking may be exercised at any time, without reason, to protect each user's peace, safety and freedom.
• 10.5 In case of blocking, the profile may remain visible in a limited way in certain lists, but interaction actions may be disabled. Badges or labels may indicate this status.
• 10.6 If a user purchases the “privileged contact” option and the targeted account blocks them within 24 hours following the purchase, FANSCORT may automatically or manually re-credit the amount of the option to the user's credit balance, subject to no abuse, fraud or breach of the Terms.
• 10.7 This re-credit applies only once per relevant purchase and only if the blocking comes from the targeted account. No refund is due if the blocking occurs after this window, if blocking is performed by the buyer, or in case of breach of the Terms.

11. Referral, ambassador and reward programs

• 11.1 FANSCORT may offer referral or ambassador programs granting benefits, credits, estimated commissions or rewards under the conditions displayed on the website.
• 11.2 These programs may be modified, suspended or terminated at any time in the event of abuse, fraud, economic, technical, legal, tax or operational change.
• 11.3 Rewards depend on eligible purchases and the terms disclosed before allocation. Indicative currency conversions may vary. A chest’s finally allocated and recorded USDC amount remains the amount under its purchase terms; later exchange-rate changes do not recalculate it. The checks and remedies in these terms continue to apply.
• 11.4 When rewards are paid in crypto-assets, including USDC, the user is solely responsible for the accuracy of their wallet address, selected network and any memo/tag required.
• 11.5 Since crypto transactions are irreversible, FANSCORT cannot be held liable for loss linked to an incorrect address, wrong network, memo/tag error, wallet incompatibility, network fees, rate variation or an unreported change by the user.
• 11.6 Rewards may be withheld, cancelled or refused in case of fraud, abusive self-referral, multiple accounts, chargeback, refund, cancelled payment, breach of the Terms or behavior intended to divert the normal operation of the program.
• 11.7 Outside Early access, Ambassador activation can be requested from 2,000 points, subject to the other program conditions. Eligible Early members are activated automatically without a points requirement. Access does not waive anti-fraud rules or payout conditions.

12. Reporting, moderation and sanctions

• 12.1 Any user may report a profile, content, message or suspicious, illegal or Terms-violating behavior through the tools available on the website or by e-mail at report@fanscort.app.
• 12.2 FANSCORT may review reports, request additional information, restrict content visibility, suspend certain features, block an account or delete content where necessary for security, legal compliance or user protection.
• 12.3 Moderation decisions may be based on a report, manual review, technical tools, fraud indicators, legal risks or manifest breach of these Terms.
• 12.4 In the event of a measure significantly affecting an account or content, the user may contact support to request a review, except in cases of urgency, serious legal risk, fraud, safety of persons or request from a competent authority.
• 12.5 Abusive, fraudulent or manifestly unfounded reports may lead to restrictions or suspension of the reporter's account.

13. Personal safety

• 13.1 Users interact under their sole responsibility.
• 13.2 FANSCORT recommends remaining cautious, never sending money to another user, not sharing sensitive information unnecessarily and immediately reporting any suspicious, abusive or fraudulent behavior.
• 13.3 FANSCORT is not a party to physical meetings, private exchanges outside the platform, personal agreements or relationships that may arise between users.
• 13.4 Blocking, reporting, verification and moderation tools are safety measures but do not guarantee the complete absence of risk.

14. Deletion, anonymization and termination

• 14.1 The user may delete their account according to the features available on the platform.
• 14.2 Account deletion may lead to anonymization of the public profile and deactivation of account access.
• 14.3 Certain data may be retained where necessary to comply with a legal obligation, prevent fraud, manage a dispute, ensure security, keep transaction evidence or protect the rights of FANSCORT and users.
• 14.4 FANSCORT may suspend, restrict or delete an account in case of breach of these Terms, fraud, abuse, security risk or request from a competent authority.

15. Website availability

• 15.1 FANSCORT uses reasonable means to ensure access to the website and services.
• 15.2 The website may be temporarily unavailable due to maintenance, update, breakdown, technical incident, cyberattack, force majeure or an event beyond FANSCORT's control.
• 15.3 FANSCORT does not guarantee uninterrupted, error-free or anomaly-free operation.
• 15.4 Temporary interruptions do not entitle the user to compensation, refund or damages, unless mandatory law provides otherwise.

16. Liability

• 16.1 FANSCORT cannot be held liable for content published by users, inaccurate information provided by them, their conduct, their exchanges outside the platform or incidents that may occur between users.
• 16.2 FANSCORT cannot be held liable for indirect losses, loss of opportunity, loss of data, moral damage or damage resulting from improper use of the website.
• 16.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

17. Personal data

The conditions for collecting, using, retaining, sharing and deleting personal data are detailed in FANSCORT's Privacy Policy.

18. Modification of the Terms

• 18.1 FANSCORT may modify these Terms to reflect changes in the service, law, technical, economic, security or compliance constraints.
• 18.2 In case of substantial modification, users may be informed by any appropriate means, including through the website, user area or by e-mail.
• 18.3 Continued use of the website after the new Terms enter into force constitutes acceptance.

19. Applicable law and jurisdiction

• 19.1 These Terms are governed by Estonian law, except for mandatory provisions applicable to the user as a consumer.
• 19.2 When the user acts as a consumer within the European Union, the choice of Estonian law cannot deprive them of the protection afforded by mandatory provisions of the law of their habitual country of residence, where applicable.
• 19.3 Subject to mandatory consumer rules, any dispute relating to these Terms or the use of the platform shall fall within the jurisdiction of the competent courts of Tallinn, Estonia.
• 19.4 Before any legal action, the parties shall, where possible, seek an amicable solution by contacting support at support@fanscort.app.

21. No commercial intermediation between users

• FANSCORT does not allow booking, payment or organization of offline services between users. Digital chests and photo or video unlocking offered by FANSCORT are governed by their specific terms and do not imply any offline service or meeting.
• The platform does not set any prices for users, does not receive any commission on possible private agreements between users, and does not intervene in their exchanges outside the platform.
• Any use of FANSCORT to offer, negotiate, sell, purchase or facilitate an illegal service is strictly prohibited.

22. Authorized countries and territorial availability

• FANSCORT is commercially available only in the countries expressly offered by the platform. It is not possible to create a listing, purchase CREDITS or activate paid options for a country that is not available on the website.
• The list of available countries may be modified, suspended or restricted at any time for legal, regulatory, tax, technical, security, payment, compliance or moderation reasons.
• The availability of a country, city or geographic area on FANSCORT does not guarantee that every possible use of the service is legally permitted there. Each user remains solely responsible for verifying that their registration, profile publication, content, communications and interactions comply with the laws applicable in their country of residence, connection or activity.
• It is prohibited to bypass FANSCORT’s territorial restrictions, including by providing a false country, false city, false residence, inconsistent payment information, or by creating a listing in a country where the platform does not authorize such activity.
• FANSCORT may refuse, suspend, cancel or restrict an account, listing, option, order or payment in the event of territorial inconsistency, legal risk, fraud, circumvention or local non-compliance.
• FANSCORT does not guarantee identical access to all features in all countries. Certain features, options, payment methods, promotional programs or verification levels may be unavailable, limited or subject to manual validation depending on the country concerned.
